I need a will
For anyone who has never made one, or whose circumstances have changed. We prepare your Will, Power of Attorney and Enduring Guardianship together so nothing is left open.
I am an executor
Someone has died and you need to apply for probate or administer the estate. We tell you what is required, what it costs, and how long it takes.
I have a business, trust or blended family
Assets held in a company or trust do not pass under a Will. We structure your estate so your intentions actually hold.

FAQs
Common questions
Do I need a lawyer to make a will?
DIY Wills frequently lead to disputes. A solicitor makes sure your Will is valid, clear, and does what you intend. If it is challenged after your death, the cost of defending it falls on your estate.
Can I change my will?
Yes. Review it every few years, and always after marriage, divorce, a birth, a death, or a significant change in assets. Marriage revokes an existing Will in NSW unless it was made in contemplation of that marriage.
What happens if I die without a will?
Your estate is distributed under the intestacy rules in the Succession Act, not according to your wishes. Someone must apply to the Supreme Court for Letters of Administration before anything can be dealt with, which adds time and cost.
What about my superannuation?
Superannuation does not automatically form part of your estate. It is paid at the trustee’s discretion unless you have a valid binding death benefit nomination in place. We check this as part of any estate plan.
What’s the difference between power of attorney and enduring guardianship?
A Power of Attorney gives someone authority over your financial and legal affairs. An Enduring Guardianship covers health and lifestyle decisions if you lose capacity. Most people need both.
I have been named as executor. What do I actually have to do?
You identify and secure the assets, apply for probate if it is required, pay the debts and tax, and then distribute what remains to the beneficiaries. You are personally accountable for getting it right. We highly recommend you review the “When is probate required in NSW” article on our website before you start.
How long does probate take in NSW?
Approximately four to six weeks for the Supreme Court to grant probate once a complete application is filed, assuming it is not requisitioned. Administering the estate afterwards usually takes several months.
Do assets in a family trust or company pass under my Will?
No. Assets held by a trust or a company are not yours to leave. Control of the trust or the shares passes separately, which is why succession planning sits alongside the Will rather than inside it.
Do I need tax advice as well?
If you hold significant assets, a business, or a trust, yes. We work alongside your accountant so the structure and the tax position line up.
Can someone contest my Will?
Eligible people, including spouses, children and certain dependants, can make a family provision claim. A well-drafted Will and clear documentation of your reasoning reduces the risk and gives your executor something to work with.
